1. Services Provided by Uniserv Education

Uniserv Education offers a range of services designed to assist students with their international education aspirations. These services typically include, but are not limited to:

• University application assistance and documentation review.

• Visa application guidance and support.

• Accommodation advice and support.

• Pre-departure briefings and ongoing support.

2. Client Responsibilities

To ensure a smooth and successful application process, your active participation and commitment are required. You agree to:

• Provide Accurate Information: Furnish all requested personal, academic, and financial information accurately, truthfully, and completely.

• Timely Submission: Submit all necessary documents and information within the agreed-upon deadlines.

• Compliance: Adhere to all guidelines, instructions, and policies set forth by Uniserv Education, educational institutions, and relevant governmental bodies (e.g., immigration authorities).

• Communication: Maintain open and timely communication with Uniserv Education regarding any changes to your circumstances, application status, or any other relevant information.

3. Authorization for University and Third-Party Communications

To effectively support your application, you explicitly authorize Uniserv Education to act as your designated representative for specific communications with universities and, where applicable, high commissions or visa application centres. You authorize Uniserv Education to initiate and accept requests including, but not limited to, the following on your behalf:

1. Acceptance and Accommodation Communications: Request the university to send all communications pertaining to your acceptance, enrolment, and accommodation directly to Uniserv Education.

2. Visa Application Extension Letters: If applicable and deemed necessary for your visa application process, request the university to issue and send an extension letter for visa application purposes to Uniserv Education.

3. Additional Documentation Requests: Request additional documentation or clarification deemed necessary for your application process to both the university and the relevant high commission or visa application centre.

4. Marketing, Educational, and Promotional Consent

You grant Uniserv Education your express consent to use photos, videos, testimonials, or any other content featuring you (e.g., quotes, written stories, academic achievements) for marketing, promotional, or educational purposes. This includes, but is not limited to:

• Social Media: Posting on platforms such as Instagram, Facebook, LinkedIn, TikTok, etc.

• Website: Featuring on Uniserv Education's official website.

• Print & Publications: Inclusion in brochures, flyers, articles, and other printed materials.

• Other Digital Platforms: Any other online or digital marketing channels.

You understand that this content may appear across various platforms, both digital and print. You may withdraw your consent at any time by contacting us directly at info@uniserveducation.com . Upon withdrawal, we will ensure your content is removed promptly from future publications.

5. Uniserv Education's Role & Limitations

Uniserv Education acts as a facilitator and advisor. We will provide guidance and support based on the information available to us and assist you in preparing and submitting your applications. However, Uniserv Education does not guarantee:

• University Admission: Acceptance into any specific educational institution. Admission decisions rest solely with the respective universities.

• Visa Approval: The approval of your visa application. Visa decisions are made by the relevant governmental authorities.

• Scholarships: The award of any scholarships or financial aid.

• Outcome Accuracy: The accuracy or completeness of information provided by third parties (e.g., universities, immigration departments), though we endeavour to use reliable sources.

6. Fees and Payment

Uniserv Education is committed to making international education accessible. As such, our core advisory and application support services are generally provided free of charge to you, the client.

However, please be aware that while Uniserv Education's direct services are free, you will remain solely responsible for any and all fees charged by third-party entities, which are distinct from Uniserv Education. These may include, but are not limited to:

• University application fees.

• Tuition fees and accommodation charges payable directly to the educational institution.

• Visa application fees and associated governmental charges.

• Travel expenses, health insurance, and living costs.

• Fees for English language proficiency tests (e.g., IELTS, TOEFL).

• Any other charges imposed by third-party service providers (e.g., courier services for documents).

Uniserv Education will endeavor to inform you of these potential third-party costs transparently throughout your application process, but it is ultimately your responsibility to cover them.

7. Confidentiality and Data Protection

We are committed to protecting your personal data. All information you provide will be handled in accordance with our Privacy Policy, which outlines how we collect, use, store, and disclose your personal data. We encourage you to review our Privacy Policy for full details.

8. Intellectual Property

All content, trademarks, service marks, logos, and intellectual property displayed on Uniserv Education's website, marketing materials, or provided through our services are the property of Uniserv Education or our licensors. You may not use, reproduce, or distribute any of our intellectual property without our prior written consent.

9. Limitation of Liability

In no event shall Uniserv Education, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use of or inability to use the service; (ii) any conduct or content of any third party on the service; (iii) any content obtained from the service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

10. Indemnification

You agree to defend, indemnify, and hold harmless Uniserv Education, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your use of the service caused damage to a third party.

11. Termination

Either party may terminate this agreement under certain circumstances. Uniserv Education reserves the right to terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the services will immediately cease.

12. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Nairobi, Kenya.

13. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will endeavour to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

15. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Uniserv Education regarding our services, superseding any prior agreements, understandings, or communications (whether written or oral).
